Parties and Scope of the Agreement

This Platform Terms of Use Agreement ("Agreement") is established between Photivu Yazılım ve Teknoloji A.Ş. ("Platform") and the natural person ("User") who accesses the Platform's website and/or creates a membership to benefit from services, in order to regulate the procedures and principles regarding the use of services offered through the Platform and to determine the mutual rights and obligations of the parties.

Definitions

• Service/Services: All content services provided by the Platform to enable Users to perform the transactions defined in this Agreement and detailed on the Platform's website, mobile application, and other digital channels.
• User(s): Natural persons who access the Platform's channels, view pages related to Services, but have not yet completed the membership registration process.
• Member(s): Natural persons who digitally access the Platform's channels, create paid or free membership registration to benefit from the Services offered, whose membership application has been approved by the Platform, and who are 18 years of age or older.
• Event: Special, collective, or social organizations such as weddings, engagements, graduations, birthdays, congresses, meetings, festivals, etc.
• Photo: Digital images taken with the explicit consent of Members or Event participants and uploaded to the Platform.

Rights and Obligations of the Parties

To acquire membership status:

• Being a fully competent natural person of at least 18 years of age,
• Filling out the membership form on the Platform with accurate, current, and complete information,
• Approving this Agreement electronically,
• Completing email/SMS verification if deemed necessary

are required.

Scope of Services, Photos, and Facial Recognition

The Platform provides a digital service infrastructure that enables Photos taken at Events to be associated with the relevant person using facial recognition technology and similar automatic matching methods, and enables individuals to easily access their own Photos.

Members can access the Event Page through event codes, links, or other verification methods; view Photos identified as belonging to them, purchase them for the determined price, and use them in accordance with the legislation.

Pricing, Payment, and Right of Withdrawal

Photo, package, subscription, or other Service fees are the prices currently stated on the Platform. The Member accepts that the total price shown at the time of purchase is the basis.

Most of the Services are digital content and instantly performed services by nature. In accordance with Article 15/1-ğ of the Distance Contracts Regulation, the right of withdrawal cannot be exercised in contracts for services that are instantly performed electronically and intangible goods that are instantly delivered.

Usage Rules and Prohibited Actions

The following actions are strictly prohibited on the Platform:

• Creating membership with false, incomplete, or misleading information
• Using the Platform for reverse engineering or revealing source codes
• Using automatic programs, robots, or data mining tools
• Using the Platform for illegal or fraudulent transactions
• Spreading viruses, malicious software, or similar harmful technologies

Intellectual and Industrial Property Rights

All software, design, database, interface, logo, trademark, domain name, text, audio-visual content, and all works belonging to the Platform are within the scope of intellectual and industrial property rights of the Company or third parties from whom it has licensed.

Limitation of Liability

Services offered on the Platform are provided "as is" and "to the extent possible"; the Company does not give any express or implied warranty regarding the suitability of the Services for a particular purpose, or that they will be uninterrupted or error-free.
